BEING ESSENTIAL protects and safeguards all your rights regarding the use of your personal data. The above applies without any discrimination and covers all processing carried out by BEING ESSENTIAL through its website and through your interaction with BEING ESSENTIAL in any way.

a) The purposes of processing are described below:

  • Communication with BEING ESSENTIAL at the initiative of the website user:

 We process your data in order to manage communication requests that you voluntarily submit to us via the contact form available on our website and to contact you following the submission of your request via the contact form.

  • Taking photographs and videos during events:

We process your data in order to post photographs and videos of events we hold on our website and on social media, and potentially for advertising purposes.

  • Carrying out transactions with customers and suppliers, and processing purchases of our products and services:

If you place an order for our products and services, or if you provide services to BEING ESSENTIAL, our employees, our customers or our partners as a supplier, BEING ESSENTIAL processes information about you so that the relevant transactions can be successfully completed (such as sending invoices, information and documents relating to payments), and also to help you manage your order.

4. How long do we retain your personal data?

In determining the retention period for your personal data, we take into account the nature of your data, its volume, the purpose of its processing, its security, etc. You have the right to ask us to delete your data, provided this does not prejudice BEING ESSENTIAL’s legitimate interests and/or there is no legal obligation to retain it, as set out above. To exercise this right, please read section 5 below.

BEING ESSENTIAL retains your personal data for the following retention periods:

  • Information about you that we collect in order to carry out transactions with customers and suppliers, and to process purchases of our products and services, will be retained for the duration of the transaction or service period, or for a longer period where required for record-keeping and legal compliance purposes.
  • If you have subscribed to our newsletters, your data will be retained for as long as you remain subscribed to our distribution lists. BEING ESSENTIAL retains unsubscribe records for 30 days.
  • Contact details, such as your full name, e-mail address and country of location collected online through our website, or other details such as your job title and telephone number collected offline through our interactions with you at BEING ESSENTIAL meetings, events or conferences, and used for marketing and sales activities, will be retained for as long as we have an active relationship (customer or prospective customer) with you. We treat you as an active contact if (i) you have interacted with BEING ESSENTIAL or updated your contact details and preferences within the last 36 months, and (ii) you have not submitted a deletion request.

 

5. What are your rights and what are the procedures for exercising them?

  • You may exercise your rights by using BEING ESSENTIAL’s contact details (section 1).
  • The rights you may exercise (as applicable and subject to the conditions set out in the UK GDPR) are as follows: the right of access (Article 15), the right to rectification (Article 16), the right to erasure (Article 17), the right to restriction of processing (Article 18), the right to data portability (Article 20), the right to object (Article 21), and the right to human intervention in automated individual decision-making, including profiling (Article 22).
  • We take the confidentiality of all records containing personal data seriously, and we reserve the right to ask you for proof of your identity if you submit a request to exercise your rights in relation to those records.
  • We will not charge you a fee for exercising your rights in relation to your personal data, unless, as provided by law, your request for access to information is unfounded or excessive, in which case we are entitled to charge a reasonable fee in the circumstances. In any event, we will inform you of any charges before completing your request.
  • We aim to respond to all valid requests within one (1) month of receipt at the latest, unless the request is particularly complex or you have made a number of requests. We will inform you if we are likely to need more than one (1) month for the reasons set out above.
  • Complaint to the Supervisory Authority: You also have the right to lodge a complaint with the supervisory authority regarding the processing of your personal data, after first contacting us so that we can try to resolve any issue you may have. 6. Who are the third-party recipients of your personal data?

BEING ESSENTIAL employees are authorised to access personal information only to the extent necessary to serve the relevant purposes and to perform their duties.

  • We may share your personal data with third parties for commercial purposes, for example with BEING ESSENTIAL distributors or resellers for further follow-up regarding your interests, with selected partners offering products and services complementary to our own, and with third parties to facilitate interest-based advertising.
 

When transferring your personal data in accordance with the above, we continually ensure the highest possible level of security. Accordingly, your data will only be transferred to service providers and partner companies that have been carefully selected and are bound by contract in advance.

Please note that where our website directs you to third-party websites, whether or not they are BEING ESSENTIAL partners, BEING ESSENTIAL has no involvement in any collection and processing of your data carried out by the operators of the third-party websites you visit.   • The information you submit to BEING ESSENTIAL is handled exclusively by specially authorised BEING ESSENTIAL personnel operating under its control and only on its instructions, and by recipients where this is necessary. For the performance of processing, BEING ESSENTIAL selects individuals with appropriate professional qualifications who provide sufficient guarantees in terms of technical knowledge and personal integrity for maintaining confidentiality. BEING ESSENTIAL, including through the corresponding contractual commitments of its partners, takes all necessary security measures to protect and safeguard the privacy, confidentiality and integrity of personal data. In any event, the security of such data within the environment of our website is subject to factors beyond our sphere of influence, as well as to factors due to technical or other failures of the network that are not controlled by BEING ESSENTIAL, or to force majeure or unforeseen events.

 

8. Do you collect sensitive information and information from children?

a) Sensitive personal data:

Please do not send or disclose to us any sensitive personal data (for example, information relating to racial or ethnic origin, political opinions, religion or other beliefs, health, genetic data, criminal background or trade union membership).

b) Children’s privacy:

As BEING ESSENTIAL focuses on serving the needs of businesses, the BEING ESSENTIAL website is not directed at minors, and BEING ESSENTIAL does not promote or market its services to minors. If you believe that we have accidentally or unintentionally collected personal information about a minor through our website without appropriate consent, please notify us immediately using our contact details in section 1 of this Privacy Policy, so that we can promptly delete the information from our servers and make any other necessary corrections. Please note that such requests may not ensure the complete or comprehensive removal of the content or information — for example, some of the content may have been republished by another user.

This Privacy Policy and any dispute arising from the use of this website, or from any other cause, shall be governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
